§ 2-248. Authority and duties generally.

  • (a)

    The authority and duties of the city manager shall be as provided in this section.

    (b)

    He shall have the power to appoint, prescribe the duties of, supervise and remove all administrative employees, except the municipal judge and the city attorney.

    (c)

    The affairs of each department of the city, including the collection and disbursement of revenue, are to be administered under the city manager's supervision and control, and he is to be responsible therefor.

    (d)

    Neither the council nor any of its committees or members shall direct the appointment of any person to or his removal from office by the city manager. Except for the purpose of inquiry, the council and its members shall deal with the administrative service solely through the city manager, and neither the council nor any member thereof shall give orders to any subordinate of the city manager, either privately or publicly.

    (e)

    It shall also be the duty of the city manager to:

    (1)

    Supervise the administration of the affairs of the city;

    (2)

    See that the provisions of this Code and other ordinances of the city and the laws of the state are enforced therein;

    (3)

    Make such recommendations to the council concerning the affairs of the city as may seem to him desirable;

    (4)

    Keep the council currently advised of the financial condition and future needs of the city;

    (5)

    Pass and submit, as provided for by this division, to the council regular reports of the affairs and finances of the city in such form and at such intervals as may be required by the council;

    (6)

    Attend meetings of the council with the right to take part in the discussion upon the request of the mayor or any member of the city council, but having no vote; and the city manager shall be entitled to notice of all special meetings;

    (7)

    Act in an advisory capacity to the city council in the formulation of policies on the city government;

    (8)

    See that all terms and conditions imposed in favor of the city or its inhabitants in any public utility franchise are faithfully kept and performed and, upon knowledge of any violation thereof, to call the violation to the attention of the city attorney, whose duty it shall be forthwith to take such steps as are necessary to protect and enforce such terms and conditions;

    (9)

    Perform such other duties and exercise such other authority as the city council may fix by resolution or ordinance.

    (f)

    All formal contracts on behalf of the city shall be executed by the city manager and attested by the city clerk after an approved resolution or ordinance of the city council.
