§ 62-172. Failure to apply fund to payment of board as promised.

  • (a)

    Any person shall be guilty of a misdemeanor who:

    (1)

    Procures board and lodging or board from any boardinghouse or innkeeper in this city upon the representation in writing that there is money due or to become due to him, to be paid on a future day, out of which he promises to pay for such board and lodging or board; and

    (2)

    Fails or refuses to so apply such money when collected by him.

    (b)

    If such person shall pay the amount due by him for such board and lodging or board and the costs of the prosecution, the case may be discontinued, in the discretion of the court.
